1. Acceptance of these terms

OutLoud MD (the "Service") is an AI-powered study simulator for the oral board exam in emergency medicine, operated by IsraeliTech ("we", "us"). By creating an account or using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. Educational purpose: self-study only

Please read carefully.

  • For educational use only. Not medical advice. The Service is a self-study and exam-preparation tool. It is not a source of medical advice, diagnosis, or treatment, and it must never be used in the care of real patients or to make clinical decisions.
  • The examiner is AI, not a physician. The AI examiner is a character generated by a language model. It is not a real physician, is not licensed, and does not substitute for any medical professional, attending, or supervisor.
  • Not a substitute for training. The Service does not replace residency training, faculty supervision, or real clinical experience.
  • Practice scenarios only. Clinical cases are fictional practice scenarios. They do not represent real patients and contain no real medical information about any person.
  • You are responsible for clinical decisions. Nothing in the Service may be applied to real patients. Every real clinical decision must rest on your own professional judgment, consultation with supervising clinicians, and current medical literature.

3. AI limitations and no warranty of accuracy

Because the Service relies on artificial intelligence, its responses, feedback, scores, and clinical details are probabilistic and may contain errors or fabricated content, including incorrect dosages, protocols, diagnostic criteria, and management steps.

  • You must independently verify all information against authoritative primary sources and current clinical guidelines before relying on it for any purpose.
  • Content may be out of date. Guidelines, protocols, and dosages change over time.
  • We do not warrant that any information generated by the Service is accurate, complete, current, or fit for any particular purpose.

4. No guarantee of exam outcomes and non-affiliation

  • No outcome guarantee. Any score or feedback the Service provides is pedagogical only. It has no official standing and does not predict, guarantee, or influence performance on any real board or licensing examination.
  • Not affiliated or endorsed. The Service is an independent study tool. It is not affiliated with, sponsored by, endorsed by, or accredited by any official board, testing organization, or licensing authority, including but not limited to the American Board of Emergency Medicine (ABEM), the National Board of Medical Examiners (NBME), and the United States Medical Licensing Examination (USMLE). Those names are used only to describe the exam the Service helps you study for, and remain the property of their respective owners.

5. Eligibility and account security

  • The Service is available only to users who are 18 years of age or older.
  • You are solely responsible for decisions made on the basis of the Service.
  • You are responsible for all activity under your account and for keeping your login credentials secure.
  • Do not share your account credentials. Notify us promptly of any unauthorized use.
  • The Service enforces rate limits. Exceeding them may lead to temporary suspension of access.

6. Acceptable use

You agree not to:

  • Scrape or automatically harvest data from the Service.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Use the Service or its output to build a competing product.
  • Overload the servers or attempt to circumvent rate limits or security controls.
  • Send unlawful, abusive, threatening, or deceptive content to the AI.
  • Impersonate another person or use a false identity.
  • Submit real patient information or protected health information.
  • Apply information from the Service to real patients.
  • Attempt to access other users' information, extract system prompts, or perform prompt injection.

7. Your content and intellectual property

You are responsible for the content you submit to the Service (chat messages, voice recordings, cases you create) and represent that you have the right to share it and that it infringes no third-party rights. Do not submit real patient information. You retain ownership of your input and grant us a license to process it to provide and improve the Service (in anonymized form). The Service software, design, methodology, and authored cases belong to us.

8. Availability and pricing

The Service is provided during an early-access period and may change, be interrupted, or be discontinued without notice. We do not guarantee uninterrupted availability. The Service is currently offered without charge; we may introduce paid plans in the future with advance notice, and price changes will not apply retroactively to an active paid period.

9. Disclaimer of warranties

The Service is provided AS IS and AS AVAILABLE, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, IsraeliTech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the Service, including but not limited to:

  • Harm to any patient resulting from applying information from the Service.
  • Failure on any real board or licensing examination.
  • Clinical decisions based on information from the Service.
  • Inaccuracies in clinical information, dosages, protocols, or diagnostic criteria.
  • Loss of data or time due to technical faults.

In all cases, our total aggregate liability is limited to the greater of the amount you paid for the Service in the 12 months preceding the event, or US $0 if the Service was provided free of charge.

11. Indemnification

You agree to indemnify and hold harmless IsraeliTech from any claim, damage, expense, or liability arising from: (a) your breach of these terms; (b) unauthorized use of your account; (c) reliance on the Service's output contrary to the warnings in Sections 2 and 3; or (d) applying information from the Service to real patients.

12. Account termination

We may suspend or close accounts for breach of these terms. You may request deletion of your account and data by contacting us at support@outloudmd.com. On deletion, personal data is removed within a reasonable time; anonymized and aggregate data may be retained.

13. Changes to these terms

We may update these terms from time to time. Notice of material changes will be sent by email or shown in the Service. Continued use after notice constitutes acceptance of the updated terms.

14. Governing law and general terms

  • Governing law: These terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules.
  • Severability: If any provision is found unenforceable, the remaining provisions stay in effect.
  • Entire agreement: These terms, together with our Privacy Policy, are the entire agreement between you and us and supersede any prior agreement.
  • Waiver: Failure to enforce any provision is not a waiver of the right to enforce it later.
